Congress of the United States: At the third session, begun and held at the city of Philadelphia, on Monday the sixth of December, one thousand seven hundred and ninety : Whereas Congress did ... recommend to the several states to pass laws making it expressly the duty of the keepers of their jails to receive and safe keep therein all prisoners ... resolved ... that in case any state shall not have complied ... the marshal ... be authorised to hire a convenient place to serve as a temporary jail.
