General note"Note.--By a subsequent act of Congress, passed the seventh of August, 1789, it is declared, that 'The president shall nominate, and by and with the advice and consent of the Senate, shall appoint all officers, which by the said ordinance were to have been appointed by the United States in Congress assembled.'"
General noteThe original was enclosed with a letter dated July 27, 1805, from Gov. William C.C. Claiborne to Secretary of State James Madison, and is presumed to have been printed in 1805.
